The following article/obituary was published in the May 8, 1952, issue of The Mountain Eagle:

CLOUD WAIVES EXAMINING TRIAL HERE WEDNESDAY FOR BERYL FULTZ SLAYING

Ben Cloud, 25-year-old Camp Branch miner, waived examining trial in Letcher County Court yesterday morning and was released on $5000.00 bond for the Saturday night slaying of his brother-in-law, Beryl Fultz, 43, on Camp Branch.

The slaying occurred about 7:00 o'clock the night of May 3, when Cloud was said to have shot Fultz twice in the neck and once in the head with a .38 calibre pistol.

Deputy Sheriff Odie Amburgey, who assisted in the investigation, said the shots had been fired from close range. Cloud came into Whitesburg and gave himself up to authorities about an hour and a half after Fultz' death.

According to witnesses, Cloud had been coming out of the hollow above the Colson school when his truck developed motor trouble and he stopped to find the trouble. Fultz was said to have come around the truck and approached Cloud at this time.

The witnesses stated that Cloud fired when Fultz was within three feet of him.

Deputy Amburgey quoted Ballard Niece as saying that Cloud came into his (Niece's) yard and said he had shot Beryl Fultz and probably killed him. Cloud then is alleged to have said that Fultz had been following him all evening.

The men were said to have been on bad terms because of an old land division dispute. Fultz was married to Blanch Cloud, Joe's sister.

Besides his wife, Fultz is survived by five sons, Richard, Donald, Kenneth, Bery Jr., Charles and Mack, and two daughters, Peggy Ann and Patsy Fultz.

Nine brothers, Willie and John, Farraday; Alton, Detroit; Elijah, Indiana; Leon, Knott County; Woodrow, Millstone; Everett, Combs, Ky.; and R. J. Fultz, Ohio; and one sister, Marie Franklin, Thornton, also survive him.

A veteran of World War II, Fultz was a miner employed at the Bill Blair mine on Camp Branch. He was born in Tennessee, Nov. 18, 1908.

Services were held at the Camp Branch Chapel Tuesday and burial was in
