Funeral Services were held in Oakland yesterday for James P. Montgomery, Oakland attorney and brother of aviation pioneer John J. Montgomery. He died Thursday at the age of 90. A resident of Canyon, Contra Costa Co., Mr Montgomery had been a member of the California State Bar since 1897. He was the last of eight children, the most famous was Professor John J. Montgomery of Santa Clara Universtiy. Professor Montgomery patented and flew the first aircraft using aero-dynamically sound wings. He himself died in a crash of one of his early machines, but his heirs fought his claim as inventor of the airplane in the courts for many years. James Montgomery is survived by his wife Rita, a son Zachery of Orinda; three daughters, Marie D. Wendt of Palo Alto, Virginia Johnson of El Sobrante and Eleanor Grafton of San Francisco and five grandchildren. Funeral services were held at the John J. Cox Piedmont Memorial Chapel in Oakland followed by a Requiem High Mass at Santa Maria Church in Orinda and interment in St. Mary's Cemetery, Oakland.
