Rutherford Todd was born in Kentucky to a large family. His brother William had paid someone to kill his older brother Madison Todd. William was sent to prison.

Rutherford attacked a tenant on his father's farm. The news article said that the tenant had a rock and that Rutherford Todd jumped down off his horse and stabbed the man many times with a pocket knife. The man later died of his wounds. Rutherford was cleared of wrong doing. His father died soon after this.

After his father passed away Rutherford went to Montana where two of his sister lived. They had married brothers named Toston. The brothers owned a cattle ranch.

William Todd, out of prison, joined the Tostons in Montana and he was killed. The law ruled it was in self defense. Soon the family sold and moved away.

Rutherford was friends with Francisco Ignacio Madero González of Mexico. Along with his brother in law Thomas Toston he tried farming in northern Mexico and they lost a lot of money in the project. Rutherford named his son Madero after his friend.
