Joined the 24th Tennessee Infantry during the late summer of 1861, possibly when the unit was camped near Bowling Green Kentucky. Wade Kirby’s home area. Kirby was originally assigned to Company “M” which served as an unattached independent Company until early 1862.
This Company was later reformed into Company “H”, sometime after the Battle of Shiloh, (April 1862).
During October 1862, Kirby was wounded at the Battle of Perryville were the 24th Tennessee, under Col. H.L. Bratton, was assigned to the 2nd Brigade under Brig. Gen. Alexander P. Stewart. This 2nd Brigade was part of the FIRST DIVISION under the command of Major General Benjamin F. Cheatham. All part of the Army of the Mississippi under General Braxton Bragg.

Kirby continued to serve with the 24th until 1865. On April 9th 1865, he was admitted to the hospital in Raleigh North Carolina. On April 13th 1865 he was captured by Federal forces at the Raleigh Hospital during the Battle of Raleigh.
