WPA Worker Gets Six-Month Term For Wife Attack

Spouse Testified He Rode Home in Taxi, Then Started Battle

Convicted of inflicting bodily injury to his aged and disabled wife, Frank Wishard, Franklin WPA laborer, was sentenced to six months on the State Penal Farm at Putnamville today by Judge Charles B. Staff in Johnson circuit court.

Wishard, arraigned on a charge of assault and battery, pleaded not guilty and was immediately put on trial. After hearing evidence from three witnesses, Judge Staff meted out the sentence and passed judgment on his finding against the defendant.

Prosecuting witness was Mrs. Mary Wishard, wife of the defendant, who signed an affidavit for her husband’s arrest after he is alleged to have struck her and knocked her to the floor of the couple’s home last Monday morning during a drunken spree.

Mrs. Wishard testified on the witness stand her husband was brought home in a taxi Monday morning and that upon entering the house he proceeded to strike her in the face with his open hand, knocking her to the floor. She testified she called city police officers and after conferring with them decided to not prosecute unless the defendant caused her further trouble.

Later Calls Police.

Later in the day, however, according to Mrs. Wishard, her husband awoke from a period of unconsciousness she testified was apparently due to intoxication and proceeded to harangue and cause her additional mental suffering. She called police the second time and requested Wishard be arrested and jailed.

Mrs. Wishard said her husband had threatened and caused her bodily injury on previous occasions and that he was almost perpetually drunk.

Lawson Sullivan, chief of the city police force, testified for the State that he had knowledge the testimony of Mrs. Wishard was true, and that he had found Wishard lying in a stupor on a bed in his home at noon Monday and that he smelled liquor on the man’s breath that evening when he was taken to jail.

When the State closed its testimony, Wishard took the stand and vigorously denied he had had a drop to drink on Monday, that he had been taken home in a taxi, and that he had in any way assaulted or injured his wife.

Wishard said he had been working on WPA the last three weeks and that he had not been drunk during that period of time. He said he went to his home Saturday night of last week with a bottle of whiskey but that Mrs. Wishard took it away from him and threw it into the yard. The bottle he said had not been opened.

Wishard was represented by Ira Haymaker, Franklin attorney, who was appointed by the court after Wishard pleaded not guilty and signified his intention of standing trial.

Immediately after the trial, Wishard was removed to jail while his wife, a white–haired fragile woman well up in years, was helped to a chair in the courtroom before being taken home.

Funeral Rites Held for Mrs. Wishard

Services were held at the Vandivier funeral home Monday morning for Mrs. Mary Wishard, who died Saturday morning at the home of Mrs. Eva Dickinson on North Main street.

Rites were conducted by the Rev. S. W. Robinson of the Methodist church. Burial was in Greenlawn cemetery. Casket bearers included Haskel Fergason, Earl Graham, Will Graham, Robert Smith, Hallard Fergason and E. L. Carr.

Mrs. Wishard was the mother of Mrs. Roy Graham of Columbus and Ira O. Gumerson of Indianapolis. Both survive.

OLAF GUMERSON - Before 1890 (See daughter, Lena #97252072, son Ira 69054992) On the 1900 census of Marion Co IN, Lena and brother Ira O. are living with their grandparents, Pennell and Melvina Keepers.
Apparently Olaf and Mary were divorced. There was an article in the "The Republic, Columbus IN" 23 Nov 1936 that "Mr. and Mrs. Roy E. Graham (that's daughter lena) were to leave today for ENID OKLAHOMA for a week's visit with her father, Olaf Gumerson."
