Det. Foley and Det. John R. Gallagher were in a restaurant located at 144 Second Ave in Manhattan, which had been robbed several times, and were waiting for another robbery to occur. While seated at a table, four armed men entered and announced a holdup. Several shots were fired and Detective Foley was mortally wounded. One suspect was also shot and wounded but was apprehended when he went to the hospital to seek medical attention for his gunshot wound. The other suspects were apprehended at the scene.
