PROBATE -Callaway Co. Missouri Probate Records 15/73 -THE LAST WILL AND TESTAMENT OF ISHAM D. BAGBY
Considering the uncertainty of the mortal life, and being of sound mind and memory, blessed be to the Almighty God for the same -- do make and publish this my last will and testament in manner and form following- that is to say- first, i give and bequeath to my beloved wife, Margaret Bagby during her natural life or widowhood all my real and personal estate, together with all my goods and chattels - after the just payment of my debts and after her death, to be disposed of as follows:
Item : I give and bequeath to my daughter, Winny Bartley the sum of fifty cents
Item: I give and bequeath to my son, Samuel C Bagby the sum of fifty cents
Item: I give and bequeath to my son, Daniel W. Bagby the sum of fifty cents
Item: I give and bequeath to my daughter, ELizabeth Dickenson the sum of fifty cents
Item: I give and bequeath to my son, Waddy C. Bagby the sum of fifty cents
Item: I give and bequeath to my daughter, Susan M Davis the sum of fifty cents
And lastly, after the death of my wife, Margaret Bagby, provided that my son, James S. Bagby and my daughter, Rosanna F. Bagby, according to my request and desire, are willing to divide the $200 legacy left to them by their brother, Joshua T. Bagby, into three equal divisions and one of said divisions to be paid to my youngest son, their brother, Thomas C. Bagby -- provided they should not be willing so to do, I request and desire to be paid to the said Thomas C. Bagby, my youngest son, as much out of my property at a fair valuation as will make his portion equal to those of his brother and sister aforesaid mentioned. I hereby appoint John T. Bagby and Benjamin Mosley my sole executors of this my last will and testament hereby revoking all former wills made by me. In witness whereof I have here unto set my hand and seal the 4th day of April in the year of our Lord one thousand eight hundred and forty five - 1845

The above instrument consisting of one sheet was now here subscribed by Isham D Bagby, the testator, in the presence of each of us and was at the time declared by him to be his last will and testament and , we, at his request, sign our names hereunto as attesting witnesses.
