He was baptised 26 Nov 1643 in Amsterdam, Noord-Holland, Netherlands at Oude Kerk (old church), son of Wynant Gerritse van der Poel and Tryntje Melgerts Roocholte van der Poel. On 4 Dec 1668 at Albany, Province of New York, British Colony, he married Ariantje Verplanck, daughter of Abraham Isaacse and Maria (Vigne) Verplanck. They were parents of eight children, all born in Albany.

Melgert was a "gunstockmaker" by trade and was appointed assistant alderman under the first charter of the City of Albany, given by Governor Dongan, 22 July 1686. He was also a member of the Governor's Council. Like his father, he was fond of real estate investments and also participated in the fur trade. He was fined by the Albany court for having Indians in his house in 1686. In 1693 he received a deed from the Reformed Dutch Church granting rights to water run and saw mill, two acres and assuring to his rights against a mill above his. He later served as a firemaster and juror. His house, like his father's, fronted the Fort in 1675 on the south side of State Street.

His wife, Ariantje, died before 29 June 1692, on which date Melgert married as his second wife Elizabeth Teller, widow of Abraham Van Tricht. They were parents of two children.

Melgert had died by September 1710. An action of the Albany Mayor's Court regarding his estate noted his six living children, real estate, two Negroes, and a sawmill on the Beaverskill. His widow was not listed, but she lived for another fifteen years.
