CHRISTOPHER HARRIS
1829 & 1833 AMENDED WILL

In the name of God Amen. I Christopher Harris of Pulaski County and State of Kentucky calling to mind the uncertainty of life and certainty of death and being at this time in the possession of all my mental faculties of a sound mind my recollection good, & my judgment calm & deliberate and feeling anxious to dispose by will of my property both real & personal and appointing the manner after death that the same shall be distributed, do make ordain publish sign & deliver this instrument of writing as my last Will & Testament. It is my will & desire that after death my body shall be buried in a decent and Christian like manner.
Having heretofore provided as liberally as I was able same as far as was right and just for the children by my first wife, and having by such provisions reduced my estate greatly it is my will and desire that my present wife, Rhoda shall use occupy and enjoy the tract of land on which we live containing one hundred acres being the same I purchased of Freemon, during her life and after her death. It is my will & desire that John Dabney Harris my son by my present wife shall have said tract of land and that at his mother’s death the titles, no fee simple to said land be vested in him forever.
It is my will & desire that my wife after my death shall use occupy and enjoy during her life all my personal estate of every description (viz) horses, hogs, cattle, sheep, household & kitchen furniture, farming utensils ____ and at her death. I give desire & bequeath the same to any son John Dabney Harris by my present wife Rhoda.
Furthermore, I give and bequeath all my estate of every description both real & personal that I may die possessed of to my wife Rhoda for and during her life and at her death I give devise & bequeath the said estate of every description both real & personal to my son John Dabney Harris by my present wife to hold to him & his heirs forever.
In testimony whereof the said Christopher Harris hath hereunto set his hand subscribed his name & affixed his seal this 18th day of March in the year of Our Lord One thousand eight hundred and twenty nine.

An amendment and codicil to the will of Christopher Harris above written, whereas since the date of the above will my present wife has born to me a daughter, Clarinda Harris. Now it is my will and desire that after the death of my present wife all the children which I have by her or their descendants instead of my son *[Benjamin]* John Dabney above, shall inherit and be entitled to all my estate both real & personal in exclusion of the children of my first wife. And to all the children which I may have by my present wife, I bequeath, will, and devise all the estate both personal and mixed which I may die possessed of after the death of my wife. This alteration & amendment is intended to make all the children by my present wife equal and joint inheritors with John Dabney the sole Owner in my first will. In testimony whereof the said Christopher Harris hath herein subscribed his name & affixed his seals this 5th day of October 1833.

At a County Court held for Pulaski County at the Courthouse thereof in the town of Somerset on Monday the 19th day of May A.D. 1834 this instrument of writing was exhibited to the court as the last Will and Testament of Christopher Harris Dec’d as also the codicil thereto annexed and proven to be the act and deed of the said Christopher Harris Dec’d by the Oath of John Fitzpatrick and Bonnie Goggin two subscribing witnesses thereto and ordered to be recorded and the same is done accordingly.

*There are two wills filed on Christopher Harris – they are identical, but in different handwriting which helps in transcription questions. One is noted “A Copy” when signed at the bottom by the clerk, Will Fox. On the Copy (where I indicated by the *) the name Benjamin was written and then cross out and John Dabney placed.

Ellen Radford’s note: This indicates that Benjamin was a son that died young.
