Supreme Court Justice Kenneth O'Brien, 58, who was serving his second elective term, died last night in Memorial Hospital, Manhattan,He was the son of the late Justice Morgan J. O'Brien, former presiding Justice of the Appellate Division, 2nd Department. Appointed to this bench in 1934 by Gov. Herbert H. Lehman, Justice O'Brien was elected to the 14 year term later that year, and in 1948, with bi-partisan endorsement was returned to the post for another term.. Justice O'Brien was a former treasurer of the Democratic National Committee and served as delegate to the 1928 and 1932 Democratic National Convention. In 1932 he was chairman of Mr. Lehman's successful campaign for the Governorship.. During World War I, he served overseas as a captain with the 77th Division. He was a graduate of Yale University and Fordham University Law School. Before his appointment to the bench, he practiced law with the firm of O'Brien, Boardman, Conboy, Menhard and Early in Manhattan In 1922, Justice O'Brien married Katherine Mackay, daughter of the late Clarence H. Mackay, telegraph company executive. The marriage terminated in divorce in 1937. Justice O'Brien, who formerly had a summer home in Southampton, was a member of the Yale Club. Manhattan Club, Friendly Sons of St. Patrick, Xavier Alumni Sodality , the Southampton Club and the National Golf Links of America. His home city was 28 E 70th St, Manhattan.
