Even though the Old Cemetery was not in existence when he died, this is a memorial to place him in the earliest, designated Duval County Cemetery. From probate records, he drowned in St. Augustine. On January 10, 1824, his son, Isaiah D Hart, and wife, Elizabeth S. Hart, were the administrators of his estate in Duval County, Florida. On July 16, 1829, the executors stated that "after two years any demands on his estate will be forever barred."
