Norris swore before a notary public the following: "About the month of June, 1861, my brother, Robert T. Norris, and myself were driving [a buggy] from St. Joseph, Missouri to our home about four miles north of Stewartsville in DeKalb County, Missouri. We had with us a revolver known as 'Pepperbox' that we were shooting along the road. The revolver got out of order and would not fire. My brother said to me that if I would hold it out, he would hit it to make it fire. I held it out and he hit the revolver, knocking it out of my hand. It fell into the wheel of the buggy and went off twice. One of the shots hit my brother in the right leg below the knee."
