The son of Charles Bingham & Valeria Fullerton (Biddle) Penrose, he married Valeria C. Merchant March 29, 1858, and fathered Sarah Merchant, Valeria Biddle, Ellen Williams, and Virginia Merchant, none of whom, it seems, has a published date of birth or ever married. In 1860, he was a lawyer living in Carlisle and described as "tall and slender in form."

A Civil War veteran, he enlisted at the stated age of thirty-six in Harrisburg June 22, 1861, mustered into federal service at Washington DC July 27 as lieutenant colonel of the 6th Pennsylvania Reserves (35th Pennsylvania Infantry), but resigned his commission for health reasons December 21, 1861. Local histories claim the health issues he suffered while in the army shortened his life.
