Police were called to the Knight's Courts on East Moran Street Sunday evening August 12, 1934 concerning a family disturbance. Mr Abston had fired his shotgun into the ground and was threatening to kill his family.
Upon arrival Abston fired both barrels of his shotgun and slightly wounded Officer John Croft. Officers W O Finley and Croft returned fire wounding Abston who died on Monday Aug 13, 1934 from a severed spinal cord.
A court of inquiry was held on Monday the 13 before Justice of the Peace, C L Meeker and was conducted by County Attorney Omar Burleson, with testimony from about a dozen witnesses. The court found that the officers acted in the line of duty and no bond was required.
