James Noland; John Wesley Noland; Levin Wheeler and Mary, his wife, late Mary Noland; Samuel Williamson and Sarah, his wife, late Sarah Noland; James Gardner and Nancy, his wife, late Nancy Noland; Moses Stitt (Scott?) and Drucilla Stitt (Scott?), late Drucilla Noland; William Willis and Hannah, his wife, late Hannah Noland; heirs and legal representatives of Philip Noland, Deceased –about 27 February 1824 Philip Noland had land -50 acres- at his demise, value $1,000.00 and personal estate value of $500.00 –being minded to make provisions for his family which consisted of all of above, plus MINORS: Benjamin Noland; Philip Noland; William Noland; Jane Noland; Elizabeth Noland; Susanah Noland; and Nancy, his WIFE, by instrument in writing he disposed of his estate as follows: - ‘ Give all moveable property to wife, Nancy Noland and 50 acres of land till William Noland became 21 years old – then land be sold and money divided among three sons: Benjamin, Philip and William, and to his three daughters named in Will – Jane, Elizabeth and Susanah he ordered wife Nancy to pay $25.00 cash when they arrived at age 18 years --- Appeal made as they were not disinherited in Will –ask that Will of Philip Noland be declared null and void. George Campbell, Executor of Will – W. Wilkins, attorney for the complaints.

Honorable Joshua Collet, President Judge of Court and Joseph Darlington, Clerk command Sheriff to summon Nancy Noland, widow and execrutrix of last Will & Testament of Philip Noland, Deceased; George Campbell, Executor of same Will; Benj. Noland; Philip Noland; William Noland; Jane Noland; Elizabeth Noland; and Susannah Noland, children and heirs of Philip Noland, Deceased to appear in case of 19 July next to answer petition against them by James Noland; John Wesley Noland; Levin Wheeler and Mary, his wife (late Noland); Samuel Williamson and Sarah, his wife (late Noland); George Cameron and Katy, his wife (late Noland); John Gardner and Nancy, his wife (late Noland); Moses SCOTT (not Stitt) and Druzilla, his wife (late Noland); William Willis and Hannah, his wife, (late Noland), heirs of Philip Noland, Dec'd Summons served on all 18 June 1824 by John W. George Vinsonhaler certified in writing that at request of Philip Noland he wrote the Will on record agreeable to Noland's direction, and Noland was instructed to name his former children in Will, but he stated he had given them all that he could – gave James Noland and Westly Noland about 50 acres of land apiece—the girls other property and he though none of his former children would attempt to "brake" (sic) the present Will.

James "served" in the War of 1812 from July 28, 1813 to July 31, 1813, at which time he "left sick" as noted on his Ohio Militia Muster Roll.
After James' death, his wife returned to Ohio. 1848 lawsuit filed in Highland county over land. James was defendant.

Silas Hart vs. The heirs of James D. Noland. (Filed March Term, 1848) Suit over land title. Plaintiff alleges that on May 27, 1824, James D. Noland, then of Highland county, now deceased, entered 68 acres on the waters of the Little East Fork of Ohio Brush Creek, Military Warrant No. 6553, in the Surveyor's Office of the Virginia Military District. He took possession and lived on said land until 1826 when he sold it to Edward Sams, who entered into possession. Noland, after receiving the purchase money, agreed to transfer the land to Sams, be he absconded to Indiana where he later died. Elizabeth, the widow of the decedant, moved back to Highland County from Indiana, purchased the land from Sams, and took possession. She sold the land to Nathaniel West of this county, who sold the land to plaintiff. In 1846, after the death of Elizabeth Noland, the plaintiff was evicted from the premises by the heirs of decedent. No patent was ever issued on said land, but the plaintiff has an equitable title. The children of James D. and Elizabeth Noland are: "Nilla Griffith formerly Noland who has intermarried with Anderson Griffith, Nancy Carlisle formerly Noland who has intermarried with Henry Carlisle, Hester Noland & Sarah (Halter or Hatter) formerly Noland who has intermarried with George Halter/Hatter, Mary Trent[Trout] formerly Noland who has intermarried with Jeremiah Trent[Trout], who reside in the County of Highland Ohio, and Doster & Agustus Noland who reside in the State of Iowa and the unknown heirs of John Noland who died in the state of Iowa which last named heirs are minors." Edward Sams lives in Iowa and Nathaniel West in Virginia. (No record. See original papers.)
