He enlisted as 3rd Lieutenant in the Alexandria Light Artillery on April 17, 1861. He was promoted to Captain October 28, 1862 and was transferred to Co. E, 18th battalion, Virginia Heavy Artillery on January 23, 1864. He was a prisoner of war at Sailors Creek (April 6, 1865). He took the oath of allegiance in Washington D.C. on May 31, 1865 and was later a member of Virginia legislature.

Colonel Smoot Passes Away

Oakland Office San Francisco Call, 1118 Broadway, Feb 12.

Colonel David S.[sic] Smoot, who was District Attorney of San Francisco nearly a quarter of a century ago, died this afternoon at the residence of his son-in-law, Benjamin Harvey, in East Oakland, The deceased was 65 years of age and had been ailing for several months.

Colonel Smoot was born in Alexandria, Virginia, and commanded a Confederate regiment during the Civil War. He came to San Francisco in 1876, and three years later was elected District Attorney. At Oakland he practiced law until three years ago, when he ceased and retired to Haywards.

The deceased leaves a widow, five daughters - Mrs. M. J. Beril, Mrs. W. C. Price, Mrs. F. A. Berlin, Mrs. W. C Robertson and Mrs. Benjamin Harvey - and one son, Rev. Calvert C. Smoot of Eugene, Or.
