On 20 September 1861, Charles enlisted in the 75th New York Volunteer Infantry as a Private for a three year term. He mustered into the 75th Regiment on 26 November 1861 and is shown on the Company G Muster Roll as receiving his first pay on 31 December. He contracted Tuberculosis during duty in New Orleans, Louisiana and was admitted to Marine Hospital. Private Avery was discharged for disability on 12 June 1863 when his doctors used the more prevalent 19th century term "consumption" (per service record).
On 20 January 1864, Charles married Hannah Celestia Burt and over the years the couple had five children. The names and years of birth of the Avery children are Lewis B., born in 1867, June, born in 1868, Celia C., born in 1871, John, born in 1873 and Clayton L., born in 1875. The 1880 US Census reveals the family had relocated to Bridgewater, Michigan where Charles states his occupation as a carpenter.
In 1896, Charles' wife Hannah passed away. He moved to Stanton, Montcalm County, Michigan according to the 1900 US Census and he was honored there by local post 37 of the Grand Army of the Republic for his Civil War service. On 4 October 1901, Charles married Josephine nee Packard Wheeler (originally of Vermont) at a small ceremony in Stanton, Michigan (per marriage record).
Charles was checked into the Michigan Soldiers Home in Grand Rapids, Kent County on 22 December 1902 where he was attended to by Doctor E.O. Bennett until his death on 7 January 1903 at the age of 69 (per Certificate of Death). His body was transported to Clinton, Michigan and buried in the Avery family lot at Benton Cemetery in Saline, Township.
