Mr. David Waller Mitchell, 74, went to be with his Lord at his home in Whitmell, VA, after an illness of several months with a kidney disease.

He was a prominent farmer in the Whitmell area.

He is survived by his wife, Mary Jane Holley Mitchell, whom he married on December 30, 1857.

He is also survived by five sons, James Coleman Mitchell, Joshua Caleb Mitchell, David Lee Mitchell, William Henry Mitchell and John Albert Mitchell and three daughters, Mrs. Clay Elliott, Mrs. A J Slayton and Mrs J T Powell, all of Pittsylvania County, VA.

He was a member of the Methodist Church for many years.

He was a Confederate Veteran. He enlisted on July 2, 1861 and served as a Private in Company H "Secession Guards", 38th Virginia Infantry Regiment. The 38th were volunteers under Armstead's Brigade - Picketts Division. He was mustered out on November 27, 1864 as a result of an inflamation on his right foot.

The 38th Virginia Infantry Regiment was part of the infamous, calamitous "Pickett's Charge" at the Battle of Gettysburg on July1, 1863. The 38th Virginia Infantry suffered a 40 percent casualty rate. Of the 484 men in the unit who saw action, 40 were killed outright; 51 were wounded; 42 were captured; and 61 were wounded and captured.

Pvt David Waller Mitchell survived "Pickett's Charge".

His brother Henry Coleman Mitchell, Jr and brother in law Henry Richardson were also Confederate soldiers.
