Son of William Rutherford and Sarah Ann Bailey. Married August 30, 1874 Joplin, Jasper Co., MO to Marietta Brayton. They had 6 children: John G. F.(died young), Annie Lavina, James Franklin, David Oscar Fulton, Forrest B.(died young) and Harry Arthur Rutherford(died young).

Worked in coal mines in Colorado and farming.

John died at the Veterans Hospital in Knoxville, IA. It's important to know that he died there, suffered from alcoholism. He claimed on the special 1905 census that he served in the Civil War, in the 25th Regiment, Missouri Infantry (Union) from June 1, 1864 through Aug 6th, 1864. This would entitle him to go the Veterans Hospital.
