Four months later, on 25 December 1861, one day after his wedding, he was taken from his home by Union forces. Hiram was "seen with the enemy" but rather than being kept in a POW camp he agreed to take "The Oath" and was allowed to return home in February 1862.
With the Civil War still raging, he enlisted on 11 October 1864 and served in Company B, 13th Missouri Cavalry "Woods Cavalry" along side his cousin Thomas F. O'Neal and brother-in-law Ransom Noell.
