Judge Flannigan was appointed by Gov Fred Warner to the Twenty-Fifth Circuit Court in Marquette, Michigan. He served until 1927, when he was appointed to the Michigan Supreme Court. He took office in January 1928 as Chief Justice. A short time later he lost a 3 week battle with pleurisy.

In 1913 Judge Flannigan presided over a most remarkable trial involving the former President, Theodore Roosevelt. The case involved him suing a newspaperman for libel. Roosevelt won his case and asked only for nominal damages. Judge Flannigan instructed the jury to return a verdict of six cents.
