THOMAS H. MALONE, M.A.

As one who has long dwelt upon the margin of a noble river, finding himself at length in the leisure of after years among its sources, traces with eager interest here the sparkling rivulet, there the quiet brook, and here again the bold mountain stream that constitute its beginnings; so one who has longwatched the flowing of a noble life, enlarging with the years, enriching the times that border it - when at last that life has flowed into the great silent sea-turns with tender eye to trace· its far-away beginnings and its course.

Thomas Henry Malone, scholar, jurist, gentleman, the father and founder, under its Board of Trustees, of the School of Law of Vanderbilt University, and its Dean for a period of nearly thirty years, extending from its organization in 1875 to the date of his resignation in June, 1904, little more than two years before his death, was born on June 3, 1834, near the town of Athens, in the county of Limestone, Alabama.

The Tennessee, turning for a time from the bosom of its mother State and winding like a horn of plenty through the upper parts of Alabama, renders famous the valley to which it gives its name and its fertility. This rich valley early attracted the eye of well-to-do Virginians, and early in the last century they began to make settlements there, and the end of the first half of the century found the valley of the Tennessee from Florence to Huntsville famed for the high breeding, wealth, and culture of its ruling population.

Thomas Chappell Malone, the grandfather of Thomas H. Malone, in the year 1818, being then resident in the county of Sussex in Virginia, removed to the valley of the Tennessee, settling at first in Madison County, and subsequently in Lime­stone· County, Ala., where he remained until his death, many of his kindred of the name accompanying him; so that when the late Rev. Doctor McFerrin, of blessed memory, came long afterwards to write of this region he said, having regard to the quality, as well as the number of those of that time, "this country was blessed with a whole legion of Malones."

A graphic and spirited picture of the Malones as they were in Virginia comes to us in a pleasant way from the late Senator John T. Mason, of Virginia. It was on this wise:

Thomas H. Malone, while a student at the University of Virginia in the fifties, was invited to ·meet some distinguished guests at the home of his own and his father's friend, Professor John B. Minor, among them being Senator Mason. The Senator being struck by the name of the young student, and having by inquiries put to him brought out the fact that the young man was the grandson of Thomas Chappell Malone, said: "Now, Mr. Malone, I know very much more of your family than you possibly can know. Shall I give you in two words the character of your people?" And then, the young student having signified that he would be glad to hear him, he continued : "Well, then, I and my fathers have known them for generations. I never knew one who was rich; I never knew one that was poor; I never knew one that was a genius; I never knew one that was a fool; I never knew one that would tell a lie or that would steal or that was afraid of the devil if he came with his horns on." A brave, strong, sturdy, high-minded stock, evidently.

Thomas Chappell Malone married his first cousin, Mary Chappell, who was of Huguenot extraction; and his son, James Chappell Malone, the father of the subject of these memoirs, thus received a double infusion of that blood which for centuries has demonstrated its wonderful prepotency in that intenseness which with marked uniformity characterizes its inheritors wherever it has flowed.

Following the paternal line one step farther back, we find that the great-grandmother of Thomas H. Malone was Elizabeth Tucker, a niece of the distinguished philanthropist, Mr. Wood Tucker, of Sussex County, Va., and a member of the great Tucker family of Virginia, a name that even down to our own times reflects honor upon a State that it is an honor to have been born in.

Turning now to the maternal ancestry of Thomas H. Malone, we find that his mother, Eliza Frances Hardiman Binford, was the daughter of John Mosby Binford, of Northampton County, N.C., a man long prominent in public life in that State, and Frances Littleberry Hardiman.

The original Binfords were Quakers, people of great wealth and culture, who settled in the counties of Charles City and New Kent, Va., whence the ancestors of John M. Binford subsequently removed to North Carolina.

Frances Littleberry Hardiman, the grandmother of Thomas H. Malone, and in whose veins flowed the blood of some of the highest of the Virginia aristocracy, was a daughter of Littleberry Hardiman, of Westover Parish, Charles City, Va., and Susana Lightfoot, whose father was a grandson of that Colonel Lightfoot who was a member of the King's Council, and one of the wealthiest men in Virginia of his day. Littleberry Hardiman was one of the justices of Charles City County in 1753, and a noted breeder and importer of thoroughbred horses. The winning of the Williamsburgh stake by his great horse, Mark Antony, in 1769 lingered in tradition among the old family slaves to a time within the memory of the subject of these memoirs himself. Martha's grandfather is William Malone 4-11 (c 1703 VA - c 1774 Dinwiddie Co, VA), son of Nathaniel Malone 3-3. Martha's grandfather in about 1724 married Ann Booth (d. c 1799 Dinwiddie Co, VA), dau of George Booth, Sr. (1679 VA - 8-14-1763 Sussex Co, VA) and Mary Booth (d. 2-3-1752 Sussex Co, VA). William and Ann's children, not necessarily in order of birth:

GEORGE MALONE 5-20, SON OF WILLIAM MALONE 4-11

George Malone 5-20 was born 12-2-1837, probably in Prince George Co at the Surry County line, son of William Malone 4-11 and Ann (Booth) Malone. He was left 40 pounds by his grandfather George Booth in his 1763 will. On 7-29-1762 he was given a a "negro fellow Toney" and acreage on Taylors Creek in Brunswick Co, VA by his father. George witnessed another deed of gift from his father to his brother Reuben Malone 5-21 on 1-1-1764. This land was also on Taylor's Creek. [21 1a] On 6-15-1773 he was patented 420 acres on Avents and Jeneto Creeks adjoining "Pennington et al." This land was in western Brunswick Co and crossed over into Mecklenburg Co. This property also abutted that of Drury Malone 4-15. Although considered a resident of Brunswick Co, George paid taxes in Mecklenburg Co. as well. He also witnessed Mecklenburg Co. deeds as well as in Brunswick Co. On 12-5-1777 he witnessed a deed of gift from his brother-in-law Drury Robertson, husband of his sister Winifred Malone 5-24 to Drury's son William. George' s brother Reuben 5-21 also witnessed the deed. George m. 1st in 1756 Sarah Bass (d. 1776). He m. 2nd 1-27-1777 Lucy (Marshall) Carter (3-7-1741 - 3-26-1821), dau of Rev. War patriot John & Tabitha Marshall, Jr. and widow of George Carter. John & Tabitha Marshall made a deed of gift of four slaves to their dau. Lucy Marshall in 1770, and his will was probated 11-14-1785 in Mecklenburg Co, VA. George had children by both wives, as noted below. He was a Rev. War Patriot, supplying material for the Continnental Army. Some have said that he was a Rev. soldier also. George witnessed another deed of gift for Drury Robertson in 1784. He thus retained property and was close to his Meherrin River/ Taylors Creek property. In 1797 George began to provide for his children. He deeded in that year 226 acres to his son Lewis Malone 6-81, living in SC, and 226 acres to son Miles Malone 6-82 of Brunswick Co, VA This was his Mecklenburg Co, property. In 1800 he deeded property to the grandchildren of his deceased daughter Mary (Malone) Vaughan of Orange Co, NC.

On 9-20-1810,"aged 72 years, 9 months and 18 days" George Malone 5-20 died, leaving a will as abstracted below:

Daughters: Elizabeth Lanier, Wilmoth Hutchinson (her husband Richard), Sally Bugg, Mary Vaughan, Patsey Lanier, Nancy Odum (Oldham). Executors: Son James Malone and son-in-law John Bugg. Witness: A . Malone, Thos Steagall, Claiborne Malone, As a Gresham, William Murrell. Estate Inventory was carried out in 1811: Brunswick Co., Va. Will Book 7, pp 459, 529, 1811: George Malone Estate Inventory.

In 1821 his second wife Lucy (Marshall) Carter Malone died, leaving her will, dated
1819:

He was in the Halifax District of Warren Co, NC in the 1790 census, and is found on an 1812 Giles Co, TN Tax list with his brother George Malone 6-89. Miles Malone is last found aged 60-70 in Monroe Co, MS in the 1830 census. No further information.

Was named a son in George Malone's will. An interesting 9-13-1815 document is noted in Brunswick Co, VA: "John Hooper of Franklin Co, GA to John Ingram of Brunswick Co, VA, for $500, all right and title which John Malone and Booth Malone, two of the sons & Legatees of George Malone, Dec'd, have to the land left them by will of the said George Malone." This document was written one month before the will was probated, and only 1 month after it was written. Booth was living in Greenville Co., SC in 1791 at the birth of his son Thomas; then lived in Franklin Co., GA. Was in Montgomery Co., TN, at least 1810-1817, and KY after 1820. He is first found in Census records in Montgomery Co, TN in 1820 aged 45 & over with 2 males 0-10, 1 male 16-18, 1 female 0-10, 2 females 10-16, 1 female 16-26, 1 female 45 & over. He is found in the 1830 Trigg Co, Ky Census, called "Roach" Malone in the census index. On examining the microfilm, your author believes the name looks exactly like "Booth" without the "t" crossed. Here he is shown aged 60-70 with wife aged 50-60; 2 males 5-10, 2 males 10-15, 1 female 5-10, 2 females 15-20. His will, dated 6-5-1830 and recorded 6-21-"1830 in Trigg Co, KY Will Book A, pp 219-220, leaves "all my estate ... to my dearly beloved wife Patsy Malone" except a servant named Tom "which I will free at the death of my wife .. " Exec to be wife Patsy and son Thomas Malone; Wit: Robert McCollum and Matilda Malone, Matilda being the wife of his son Thomas D. Malone. The 1840 census shows Thomas D . Malone and Moses Malone as heads of households in Trigg Co, KY. One older famale is living in the home of Thomas, presumably Martha ("Patsy") Malone. The 1850 census showed his wife Martha aged 75, a weaver, living in the household of her granddaughter Lucy Spencer, aged 40, a seamstress with young children, with the Malone sons and grandsons living in areas nearby. (Martha household #330, Miles #331, Moses #329, Thomas D. #332.) Apparently he had already given land to his sons prior to his will. Martha left her will dated 8-25-1854 found in Trigg Co, KY Will Book "E", p 146. It leaves 1/8 of her negroes from Booth Malone's estate to go to son Thomas D. Malone, 1/8 to dau. Susan Travis, 1/3 of 1/8 to grand daughter Catherine Spencer. The remainder of the estate was to be sold and the money divided equally among the remainder of her children and grand children. Her son Thomas D. Malone was to be her executor. The estate was settled by Thomas D. Malone on 9-11-1860, as noted in Trigg Co, KY Will Book "E", p. 617. The estate was divided between son Thomas D. Malone , dau. Susan Travis, dau. Elizabeth Mills, dau Nancy (Malone) Roberts, wife of William Roberts. In addition, portions were given to grandson Moses Malone, Lucy Spencer, and four children of Mary Thompson named Milus H., Thomas W., William B. and Martha. Another portion went to grand daughter Catherine Spencer, "late Farrow"; another to Samuel Farrow and to John Farrow, heirs. As one who has long dwelt upon the margin of a noble river, finding himself at length in the leisure of after years among its sources, traces with eager interest here the sparkling rivulet, there the quiet brook, and here again the bold mountain stream that constitute its beginnings; so one who has longwatched the flowing of a noble life, enlarging with the years, enriching the times that border it - when at last that life has flowed into the great silent sea-turns with tender eye to trace· its far-away beginnings and its course.

Thomas Henry Malone, scholar, jurist, gentleman, the father and founder, under its Board of Trustees, of the School of Law of Vanderbilt University, and its Dean for a period of nearly thirty years, extending from its organization in 1875 to the date of his resignation in June, 1904, little more than two years before his death, was born on June 3, 1834, near the town of Athens, in the county of Limestone, Alabama.

The Tennessee, turning for a time from the bosom of its mother State and winding like a horn of plenty through the upper parts of Alabama, renders famous the valley to which it gives its name and its fertility. This rich valley early attracted the eye of well-to-do Virginians, and early in the last century they began to make settlements there, and the end of the first half of the century found the valley of the Tennessee from Florence to Huntsville famed for the high breeding, wealth, and culture of its ruling population.

Thomas Chappell Malone, the grandfather of Thomas H. Malone, in the year 1818, being then resident in the county of Sussex in Virginia, removed to the valley of the Tennessee, settling at first in Madison County, and subsequently in Lime­stone· County, Ala., where he remained until his death, many of his kindred of the name accompanying him; so that when the late Rev. Doctor McFerrin, of blessed memory, came long afterwards to write of this region he said, having regard to the quality, as well as the number of those of that time, "this country was blessed with a whole legion of Malones."

A graphic and spirited picture of the Malones as they were in Virginia comes to us in a pleasant way from the late Senator John T. Mason, of Virginia. It was on this wise:

Thomas H. Malone, while a student at the University of Virginia in the fifties, was invited to ·meet some distinguished guests at the home of his own and his father's friend, Professor John B. Minor, among them being Senator Mason. The Senator being struck by the name of the young student, and having by inquiries put to him brought out the fact that the young man was the grandson of Thomas Chappell Malone, said: "Now, Mr. Malone, I know very much more of your family than you possibly can know. Shall I give you in two words the character of your people?" And then, the young student having signified that he would be glad to hear him, he continued : "Well, then, I and my fathers have known them for generations. I never knew one who was rich; I never knew one that was poor; I never knew one that was a genius; I never knew one that was a fool; I never knew one that would tell a lie or that would steal or that was afraid of the devil if he came with his horns on." A brave, strong, sturdy, high-minded stock, evidently.

Thomas Chappell Malone married his first cousin, Mary Chappell, who was of Huguenot extraction; and his son, James Chappell Malone, the father of the subject of these memoirs, thus received a double infusion of that blood which for centuries has demonstrated its wonderful prepotency in that intenseness which with marked uniformity characterizes its inheritors wherever it has flowed.

Following the paternal line one step farther back, we find that the great-grandmother of Thomas H. Malone was Elizabeth Tucker, a niece of the distinguished philanthropist, Mr. Wood Tucker, of Sussex County, Va., and a member of the great Tucker family of Virginia, a name that even down to our own times reflects honor upon a State that it is an honor to have been born in.

Turning now to the maternal ancestry of Thomas H. Malone, we find that his mother, Eliza Frances Hardiman Binford, was the daughter of John Mosby Binford, of Northampton County, N.C., a man long prominent in public life in that State, and Frances Littleberry Hardiman.

The original Binfords were Quakers, people of great wealth and culture, who settled in the counties of Charles City and New Kent, Va., whence the ancestors of John M. Binford subsequently removed to North Carolina.

Frances Littleberry Hardiman, the grandmother of Thomas H. Malone, and in whose veins flowed the blood of some of the highest of the Virginia aristocracy, was a daughter of Littleberry Hardiman, of Westover Parish, Charles City, Va., and Susana Lightfoot, whose father was a grandson of that Colonel Lightfoot who was a member of the King's Council, and one of the wealthiest men in Virginia of his day. Littleberry Hardiman was one of the justices of Charles City County in 1753, and a noted breeder and importer of thoroughbred horses. The winning of the Williamsburgh stake by his great horse, Mark Antony, in 1769 lingered in tradition among the old family slaves to a time within the memory of the subject of these memoirs himself. GEORGE MALONE 5-20, SON OF WILLIAM MALONE 4-11

George Malone 5-20 was born 12-2-1837, probably in Prince George Co at the Surry County line, son of William Malone 4-11 and Ann (Booth) Malone. He was left 40 pounds by his grandfather George Booth in his 1763 will. On 7-29-1762 he was given a a "negro fellow Toney" and acreage on Taylors Creek in Brunswick Co, VA by his father. George witnessed another deed of gift from his father to his brother Reuben Malone 5-21 on 1-1-1764. This land was also on Taylor's Creek. [21 1a] On 6-15-1773 he was patented 420 acres on Avents and Jeneto Creeks adjoining "Pennington et al." This land was in western Brunswick Co and crossed over into Mecklenburg Co. This property also abutted that of Drury Malone 4-15. Although considered a resident of Brunswick Co, George paid taxes in Mecklenburg Co. as well. He also witnessed Mecklenburg Co. deeds as well as in Brunswick Co. On 12-5-1777 he witnessed a deed of gift from his brother-in-law Drury Robertson, husband of his sister Winifred Malone 5-24 to Drury's son William. George' s brother Reuben 5-21 also witnessed the deed. George m. 1st in 1756 Sarah Bass (d. 1776). He m. 2nd 1-27-1777 Lucy (Marshall) Carter (3-7-1741 - 3-26-1821), dau of Rev. War patriot John & Tabitha Marshall, Jr. and widow of George Carter. John & Tabitha Marshall made a deed of gift of four slaves to their dau. Lucy Marshall in 1770, and his will was probated 11-14-1785 in Mecklenburg Co, VA. George had children by both wives, as noted below. He was a Rev. War Patriot, supplying material for the Continnental Army. Some have said that he was a Rev. soldier also. George witnessed another deed of gift for Drury Robertson in 1784. He thus retained property and was close to his Meherrin River/ Taylors Creek property. In 1797 George began to provide for his children. He deeded in that year 226 acres to his son Lewis Malone 6-81, living in SC, and 226 acres to son Miles Malone 6-82 of Brunswick Co, VA This was his Mecklenburg Co, property. In 1800 he deeded property to the grandchildren of his deceased daughter Mary (Malone) Vaughan of Orange Co, NC.

On 9-20-1810,"aged 72 years, 9 months and 18 days" George Malone 5-20 died, leaving a will as abstracted below:

He was in the Halifax District of Warren Co, NC in the 1790 census, and is found on an 1812 Giles Co, TN Tax list with his brother George Malone 6-89. Miles Malone is last found aged 60-70 in Monroe Co, MS in the 1830 census. No further information.

An interesting 9-13-1815 document is noted in Brunswick Co, VA: "John Hooper of Franklin Co, GA to John Ingram of Brunswick Co, VA, for $500, all right and title which John Malone and Booth Malone, two of the sons & Legatees of George Malone, Dec'd, have to the land left them by will of the said George Malone." This document was written one month before the will was probated, and only 1 month after it was written. Booth was living in Greenville Co., SC in 1791 at the birth of his son Thomas; then lived in Franklin Co., GA. Was in Montgomery Co., TN, at least 1810-1817, and KY after 1820. He is first found in Census records in Montgomery Co, TN in 1820 aged 45 & over with 2 males 0-10, 1 male 16-18, 1 female 0-10, 2 females 10-16, 1 female 16-26, 1 female 45 & over. He is found in the 1830 Trigg Co, Ky Census, called "Roach" Malone in the census index. On examining the microfilm, your author believes the name looks exactly like "Booth" without the "t" crossed. Here he is shown aged 60-70 with wife aged 50-60; 2 males 5-10, 2 males 10-15, 1 female 5-10, 2 females 15-20. His will, dated 6-5-1830 and recorded 6-21-"1830 in Trigg Co, KY Will Book A, pp 219-220, leaves "all my estate ... to my dearly beloved wife Patsy Malone" except a servant named Tom "which I will free at the death of my wife .. " Exec to be wife Patsy and son Thomas Malone; Wit: Robert McCollum and Matilda Malone, Matilda being the wife of his son Thomas D. Malone. The 1840 census shows Thomas D . Malone and Moses Malone as heads of households in Trigg Co, KY. One older famale is living in the home of Thomas, presumably Martha ("Patsy") Malone. The 1850 census showed his wife Martha aged 75, a weaver, living in the household of her granddaughter Lucy Spencer, aged 40, a seamstress with young children, with the Malone sons and grandsons living in areas nearby. (Martha household #330, Miles #331, Moses #329, Thomas D. #332.) Apparently he had already given land to his sons prior to his will. Martha left her will dated 8-25-1854 found in Trigg Co, KY Will Book "E", p 146. It leaves 1/8 of her negroes from Booth Malone's estate to go to son Thomas D. Malone, 1/8 to dau. Susan Travis, 1/3 of 1/8 to grand daughter Catherine Spencer. The remainder of the estate was to be sold and the money divided equally among the remainder of her children and grand children. Her son Thomas D. Malone was to be her executor. The estate was settled by Thomas D. Malone on 9-11-1860, as noted in Trigg Co, KY Will Book "E", p. 617. The estate was divided between son Thomas D. Malone , dau. Susan Travis, dau. Elizabeth Mills, dau Nancy (Malone) Roberts, wife of William Roberts. In addition, portions were given to grandson Moses Malone, Lucy Spencer, and four children of Mary Thompson named Milus H., Thomas W., William B. and Martha. Another portion went to grand daughter Catherine Spencer, "late Farrow"; another to Samuel Farrow and to John Farrow, heirs. Deed Book A, p 149, dated 2-11-1836 is a partnership deed between Robert C. Malone and Wylie R. Malone of Giles Co, TN showing that Robert C. Malone is about to leave Yalibusha Co, MS, leaving business matters in the hands of W. R. Malone, who is given power of attorney. Your author finds no census records for Robert C.Malone in MS.
