Alston was a member of the Georgia State House of Representatives. On March 11, 1879, Ed Cox entered the Georgia State Capital building, intent on killing Col. Alston over a business disagreement. Knowing his life was in danger, Alson was given a pistol by a friend for protection. When Cox drew his weapon, they both began firing at each other. Alston was mortally wounded.
