LAST WILL AND TESTAMENT OF ZIBA WILSON CUTTING
In the name of God Amen, I Ziba Cutting widow of the late David Cutting deceased of the Town of French Creek in the County of Chautauque, State of New York of the age of Eighty four years and being of sound and disposing mind and memory do make publish and declare this my last will and Testament in manner following, that is to say
First. I give and bequeath to Luther H. Case of Said Town of French Creek the sum of one hundred and fifty dollars; and to Darwin A. Case the sum of one hundred & fifty dollars; and to my niece Sally Weston wife of Samuel Weston one hundred dollars, and to Lucy Case, wife of Nathan G. Case, two hundred dollars, and to Lucy A. Case fifty dollars, and to Henry R. Case fifty dollars and all the residue except one hundred and fifty dollars which I bequeath to the Baptist Church and Society now existing in the South part of the Town of French Creek aforsaid which said several sums of monies I direct and order to be paid to the said respective legatees within one year after my decease. Lastly I appoint Philip Reynolds sole executor of this my last will and testament hereby revoking all formed wills by me made.
In witness thereof I have hereunto set my hand and seal this 10th day of July 1856

This written instrument consisting of one half sheet was at the date thereof Signed Sealed and published and declared by the said Ziba Cutting as and for her last will and testament in the presence of us who at her request and in her presence and in the presence of each other have subscribed our names as witnesses thereto:
I. F. Gleason Residing at Clymer, Chautauque County
E. N. Brown Residing at French Creek, Chatauque County
Recorded the forgoing last will and testament of Ziba Cutting deceasd this thirteenth day of October A.D. 1860.

Whereas I Ziba Cutting French Creek in the County of Chautauque State of New York have made my last will and testament in writing bearing date of 10th July 1856 in and by which I have bequeathed to Luther H. Case one hundred and fifty dollars. Now therefore I do by this my writing which I hereby declare to be a codicil to my last will and testament and to be taken as a part thereof order and declare that in consequence of having received notes against the said Luther H. Case from the administrators of the Estate of David Cutting deceased and having cancelled and given up the said notes to the said Luther H. Case it is my will that the said bequest in my said will be void and taken as fully satisfied.
And lastly it is my desire that this codicil be annexed to and be made a part of my last will and testament as aforsaid.
In witness thereof I have hereunto set my hand and seal this 25th day of August 1856
