James was the son of William M. and Elizabeth Lee Acton. He was born in Jefferson County, Alabama. He married Mary Ann Byars on October 9, 1856. They had two children:

John L. Jackson Acton 1859 - 1859
Mary James Acton 1862 - 1922

James enlisted as a Corporal in the 20th Alabama Infantry Company G C.S.A. On April 3, 1862, While home on furlough he became ill and was taken by the "Home Guard" . It is believed that he was taken due to his knowledge of horse theft by "The Home Guard." He was never seen again.

There is also record of his death in a military hospital in Knoxville Tennessee.

James had six brothers who served in the Confederate Army:

Dr. William M. Acton 1841 - 1875
Aaron C. Acton 1844 - 1919
