I, Brice Arbaugh, of Brooke County, and State of West Virginia, do make my last will and testament in manner and form following that is to say:
First. I desire that my funeral expenses, and debts, if any, shall be paid first, out of my property, by my executor.
Second. my said Executor shall pay to my brother, George W. Arbaugh, and to my sisters Eliza Sheets, Catharine Ferrell, and Abagail Bickenstaff, each, should they survive me, the sum of one dollar; or if any of them should survive me, to such survivor or survivors the said sum of one dollar each; and to my father Jacob Arbaugh the sum of five dollars should he outlive me.
Third. All the remaining part of my real and personal estate, not disposed of as above, I desire shall be applied to the joint support of my mother during her life, and my sister Lavinia Arbaugh; and after the death of my mother all the remainder of my said real and personal estate shall be inherited by my said sister Lavinia.
Fourth. In consideration of the above bequest in favor of my sister Lavinia, I here by enjoin upon her and make the same obligatory upon her namely to remain with her mother and nurse her and take all possible care of her during her life.
Fifth. In case my said sister Lavinia should die before my mother then upon the decease of mother, I desire that the portion of my estate, of whatever sort then remaining, shall go to my father Jacob Arbaugh.
Sixth. I hereby authorize and empower my Executor to sell any or all of my real and personal property, or so much thereof as may be necessary, to carry out the provisions of this my will and I desire that no inventory or apportionment of my real and personal property may be taken, unless absolutely necessary.
Seventh. I nominate Leander Browning to be the executor of this my last will and testament.
In testimony where of, I have herewith set my hand and seal this 21st day of July, 1874. Brice Arbaugh.
