Burton Whaley was the son of Isaac William Whaley and Hulda "Ogle" Whaley. Burton married Lucy Alice Cardwell, daughter of Robert Cardwell III and Nancy Mayes-Cardwell. Burton and Lucy married in Sevier County, Tennessee April 13, 1873

Burton and Lucy had the following Children;
