HOLDS TESTIMONY ON LOST WILL TO BE INCOMPETENT IN LAW

Witnesses Failed to Sign Will in Presence of Testator and Court Refuses to Accept their Testimony on Contents Because the three witnesses to the document had failed to sign it in the presence of the testator, though they had witnessed her signature, Judge Chloupek in probate court today declined to accept the testimony of the witnesses to the will of the late Mrs. Beregetta Jeraldson (sic) of Rapids and the estate will have to go through the regular channels of the court for distribution to heirs.

Mrs. Jeraldson made a will on March 6 and died four weeks later. After her death the will could not be found, having been mislaid or lost and an effort was made to establish its contents by testimony of the three persons who witnessed to document. When the hearing was called it developed that the witnesses after Mrs. Jeraldson had signed the will in their presence, went to another roo mand (sic) attached their signatures and as the law requires that the witnesses must sign, in the presence of the testator. Judge Chloupek refused to consider the testimony.
