David was married October 23, 1845, to Elizabeth Wenger, by Rev. Daniel Hertz in Lancaster County, Pa.

About 1852, he moved from the Pine Hill area of Warwick Township, Lancaster County, Pa., to Sugar Creek Township, Wayne County, Ohio.

Will of David Eby, Estate #6075, Wayne County, Ohio, dated Sept. 27, 1883, filed Feb. 11, 1884. Witnesses: Samuel Snyder and Henry Zartman.
“In the Name of the Benevolent father of all I Daniel Eby of Sugarcreek Township, Wayne County, Ohio, Ohio, do Make and publish this my Last Will and Testament.

I. give and devise to my Beloved wife Elizabeth Eby all My Real Estate and personal property during Her Life and after the death of My wife it is my wish that my property be sold and the Money to equally divided among my Lawful Heirs.

2. item. if my wife Elizabeth Eby Sees proper She is Hereby authorized to Sell all the Real Estate and personally property and invest the Money in other Real Estate and Hold it during her life Time and then divide the money among My lawful Heirs.

I do Hereby appoint my Son Elias Eby and My dauter Mary Seidle to Be My Executors of this my last will and testament.

signed, David (wiped off) and “Eby” change to My wish that no appraisement of My property be dispensed with and that My Executors be Not Required to give Bond.

In Testimony hereof I have hereunto Set my Hand and Seal this 27th day of September A. D. 1883.

Elias and Anna did not file for Letters Testamentary until May 1, 1905 (after Elizabeth’s death). It took eight years to settle. A final account was filed on Sept. 10, 1913.

On May 8, 1905, Elias Eby and Anna Sidle filed a petition to sell the real estate in a civil action (No. 4074) against, Susan M. Brainard, Jacob B. Eby, David W. Eby, Joseph S. Eby, Arclissa R. Eby, Leah M. Gallatin, Eliza J. Eby, Albert Eby, a minor under 14 years of age and Minerva Eby, a minor under 14 years of age, Anna Kurtz and Eliza Kurtz as Executors of the Estate of Benjamin Kurtz, deceased. The executors stated that David Eby’s debts totaled about $600, that administration costs would equal about $250, and the total value of the estate was less than $10. They requested that David’s land in a part of the northwest quarter of Section 34, Township 16 of Range 11, consisting of a parcel of 20 acres, and another parcel of 17.33 acres (less 3 acres). NB. The Kurtzes were not heirs, but rather mortgage holders as executors of the estate of Benjamin Kurtz.
