5. DEATH: Last Will & Testament of Joseph Barnett dated and signed with his seal, 14 DEC 1867 in Caldwell County, TX. Believe that the death date on tombstone is incorrect.
Heirs include wife, Mary and all if my legal bodily heirs, including the different families of my deceased daughters as 1 heir, each making 12 in number, each receiving equal shares, excepting my deceased daughter, Aby Hester, they to receive their portion as they become of age, and I do hereby appoint Robert Gray, my son-in-law, to act as trustee & guardian for them.
Lastly I appoint my son-in-law, Samuel McCarley, as sole executor.
Filed & recorded in Caldwell County, TX in January Term, 1868.
6. LAND: At the time of his death, Joseph Barnett had over 2,200 acres of land in Caldwell County, all out of the James Hinds League Survey. He also had land in San Saba County.
