MURDER
William Toliver killed George Reeves, Jr.(brother of his wife) in 1811.
He was not convicted of the killing.
It was called justified.

ONE VERSION
The History of Western NC by John Preston Arthur says that "Tradition says that Tolliver was acquitted at Wilkesboro on the ground that Reeves had attempted liberties with Tolliver's wife." (That would have been incest)

ANOTHER VERSION
George Reeves was a tax collector.
Dennis Smith, a descendant, says that George was taking horses for taxes and William thought he was stealing the horses and shot.
Earlier William had had a horse stolen by Paul Collins.
The jury found him not guilty of the felony
and murder as charged, but guilty of the felony of manslaughter.
His punishment was to "be burned on the brawn of the left thumb with the impression of the letter M and that the Sheriff of this county carry this sentence immediately into execution in the presence of the Court."
He was imprisoned for 3 years and fined 1000 pounds.
Dennis says that he sold his land to his
brother-in-law, Joseph Doughton, after he got out of jail and then left NC.

THE UNWRITTEN LAW IN 1811.
At the March term, 1811, of the Superior Court of Ashe, Samuel Lowery, judge presiding, an order was made for the removal to Wilkes court, to be held on the third Monday of March, of the case of the State versus William Tolliver, indicted for the murder of a man named Reeves; and the sheriff of Ashe was required to "procure a sufficient guard of eight men from the proper officers of the militia to convey safely the said William Tolliver to the Superior court of Wilkes county," thus indicating either that there was danger of a lynching or a rescue.
Tradition says that Tolliver was acquitted at Wilkesboro on the ground that Reeves had attempted liberties with Tolliver's wife. Robert Henry of Buncombe defended him.
Per book "History of Western North Carolina" by John Preston Arthur, page 376.

This tradition is unlikely because Tolliver's wife was Susannah "Sukey" Reeves, who was the daughter of George Reeves, Sr. and Jane Burton as well as the brother of George Reeves, Jr., the deceased.
And then I found this reference.
3/21/1811: State vs. William Tolliver, murder, John and Susannah Buryon as witnesses failed to appear; John Higgins a witness was absent.” Look for in Wilkes Co, NC Court Minutes.

In 1811 George Reeves, Sr. (William's father in law)died.

It is possible that William is living with Susanna in 1830.
There is a 50-60 year old male in the

Seeking info on William TOLIVER that came to Orange county around the 1830's-?.
He was supposed to have owned a farm, now at the bottom of Patoka Lake.
His son, James Madison was b. 1811 in VA.
I don't know what happen to William Toliver, and I am trying to find some one that might know.
I was wondering if he may have been buried in the cemeteries that were removed to the Memorial Cem.
James Madison was married twice, once to Mary COX then to Mary Polly DALTON.

Some say that William is buried in Freedom Cemetery, but I can't find anyone that has the names of the people that are buried there.

NOTES FROM Charlotte
Seeking info on William TOLIVER that came to Orange county around the 1830's-?.
He was supposed to have owned a farm, now at the bottom of Patoka Lake.
His son, James Madison was b. 1811 in VA.
I don't know what happen to William Toliver, and I am trying to find some one that might know.
I was wondering if he may have been buried in the cemeteries that were removed to the Memorial Cem.
James Madison was married twice, once to Mary COX then to Mary Polly DALTON.

Some say that William is buried in Freedom Cemetery, but I can't find anyone that has the names of the people that are buried there.

William Toliver (son of John Toliver and Elizabeth Symmes)1873 was born 17581874, 1875, 1876, and died 1824 in Warren co, TN1877, 1878.

He was born before 1750, maybe in Fauquier Co., VA; d. 1824, Warren Co., TN; m. (1) Susannah REEVES?; m. (2) Juda DENNY BALTRIP, a widow, bef. 1805
William Toliver first appears on the 1771 Tax List of Surry Co., NC. In 1778 and 1779, he entered claims for land in Wilkes Co., NC, on Harris's Creek and the south fork of the Roaring River. (Wilkes Co., NC, Land Entry Book, Nos. 152, 817, 1244.)
