Thomas and his first wife, Frances had seven children:
Hon. Frances Erskine b. 1771, d. 25 Mar 1859 who married Rev Samuel Holland
Hon. Elizabeth Erskine b. 1772, d. 2 Aug 1800 who married Sir David Erskine (son of David Steuart Erskine).

Thomas married Sarah Buck on 12 October 1818 in Gretna Green, Dumfries-shire, Scotland.
His four children to Sarah were legitimated.
They separated on 21 June 1821.

In 1823 Thomas set out by sea to visit Scotland with one of his sons, hoping to see his brother David, the Earl of Buchan, at Dryburgh Abbey, Berwickshire. But he became ill with a chest infection on the journey and was put ashore at Scarborough. He managed to travel to the home of his deceased brother Henry's widow in Almondell in West Lothian (just west of Edinburgh), where they were joined by the earl. He died from the lung inflammation.

Thomas was buried in the vault beneath the tower, the burial place of the Earls of Buchan, the Erskines.
The stones were originally laid on the Tower floor but were
lifted in 1938 for their preservation.
There is a wall tablet commemorating Thomas, Lord Erskine, Lord Chancellor of England and his brother the Hon. Henry Erskine, Lord Advocate of Scotland.
