Fabius twelve years old when his father died in 1836, the year of the Texas Revolution. There is "a Mr. Toney from Alabama" listed as inquiring into the probate process of Silas Fuqua's will, executed in Gonzales County, Texas, and a ship list showing Fabius age 12 and Lucas age 13, sailing from Matagorda to New Orleans in 1837, shortly after Silas died, with a Mr. Charles Toney, age 71. Since their great aunt Zelphia, the sister of their maternal grandmother Celia Bondurant Fuqua, was married to a Charles Toney, it is assumed to be him and that the young boys are returning to Alabama to live with them until reaching majority. Silas still owned property at the time of his death in what was then Franklin County, Alabama (now Colbert Co.) and Lucas is listed in family records as dying in Alabama in 1848. Fabius returned to Texas, probably after the age of 18 or 21and following his service in the Mexican War witha regiment from Tennessee. He married in 1867 and lived on the family land grant.
