Perogative Court of Canterbury Will Dated 17th February 1833
Ann Tolhurst, wife of William Tolhurst of Teynham, Labourer.
By an indenture dated 18th August 1819 made previous to her marriage with William Tolhurst, between William Tolhurst on the 1st part, herself the 2nd part and Robert Busbridge and William Hodges, the 3rd part, three sums of money were vested in Robert Busbridge and William Hodges, upon trust, for the use of herself during her intended coverture, and from her death, upon trust, to transfer the sum of money or interest to such person in such portions as she directs. Robert Busbridge has since died and Edward Blaxland of Dadman's in Lynsted, Gentleman, has been appointed in his place. She desires her husband if he survives her, to receive the interest of the trust money for his lifetime, by power of the indenture she gives her husband the interest and directs William Hodges and Edward Blaxland to pay him this money, the latter are executors.
Witnesses: Richard Bathurst and Richard Bathurst, Junior
Proved 16th June 1840

William Tolhurst, her husband is sole person entitled to the personal estate and effects, "over which she has no disposing power and concerning which she is dead intestate having first consented (as by Acts of Court appears)"
