However, the distribution of monies from the sales of his estate was contested for over 19 years. Per DAR, James Hunter Chapter, Families of NC Counties of Rockingham and Stokes, Vol 2, 1977: As a resident of Guilford Co, NC during the Revolutionary War, James Oliver was drafted in 1780 as a private in the company of Capt Josiah Gates in Col. James Martin's Regiment of Militia. He took part in the Battle of Guilford Court House. Per Sketches of the Olivers, A Family History 1726-1966, p1987 by Colonel Hugh R. and Margaret T. Oliver: "In 1852, the attorney submitting Susannah's application for a pension said, "Her husband from Patriotic motives never applied for a pension in his lifetime, being as he said able to live without taxing his country." Truly the spirit of the Revolution lived in the heart of this old soldier, an example then and still a standard of high honor today." James maintained a family bible which contains many records of his immediate family.
