I Daniel Burt of Taunton in the county of Bristol seriously considering the uncertainty of this mortal life and being in a weak state of bodily health, tho of as clear memory as usual, thanks to God for the same, do this day make this my last Will and Testament.
I most humbly recommend my Soul to that extensive mercy of the Supreme Being who gave it to me, my worldly estate I dispose in manner and form following:
First. I give to my well beloved Wife all my House Hold Furniture and indoor moveables forever to sell or give to whom she may think proper. And I give one third part of my real estate of Lands to her during her natural life, I mean of all I possess in the Commonwealth of Massachusetts I give her one cow and four sheep.
Item. I give and devise to my son Daniel Burt one fourth part of all my Real Estate in the Commonwealth of Massachusetts which shall be remaining after my debts are paid, and to be divided or set off out of the two third so as to be clear of the incumbrance of my wife's third and to be done as soon as my just debts shall be paid. And all my Real Estate situate at the Genessee in the State of New York.
Item. I give and bequeath to my daughter Betsy Burt one hundred and fifty dollars, and the same amount in Furniture for housekeeping house as I have given to my daughter Thankful Walker and to be paid out of the remaining part of my Real Estate in this Commonwealth afor the one fourth part is set off to my son Daniel .
And all that shall remain of the three quarters of my Real Estate, after my debts and the Legacy given to my daughter Betsey as said, I give and devise to my two Daughters Betsey Burt and Thankful Walker to be equally divided between them.
And I do nominate and appoint my brother Henry Burt of Taunton to be my Executor to this my last will and Testament and he to pay my just debts, funeral charges and Legacies and to receive my credits.
And all the remainder and residue of my Estate whether in Stock or outdoor moveables or in whatever else not expressly given away in this will I order my Executor to sell for the discharge of my debts as far as it will go.

There being three children and heirs of said deceased viz Daniel Burt, Thankful Walker and Betsey Burt.
