DANIEL4 (Thomas3, James2, James1,) born 1735; died October 5, 1802. He lived at his father's homestead on Burt street, which now (1893) forms part of the estate of the late George Walker, Esq.; wife Bettey, born 1738, died December 14, 1821. Their children were:

Daughters:
Thankful5, b. 1765; m. Doctor George Walker; she died December
18, 1837.
Betsey5, b. 1767; d. June 15, 1833, unmarried; was called "Tall Betty."
His will is dated February 5, 1802; bequests are made to wife whose name is not given, and three children above mentioned; brother Henry appointed executor.

DANIEL BURT'S WILL
This fifth day of February 1802
I Daniel Burt of Taunton in the county of Bristol seriously considering the uncertainty of this mortal life and being in a weak state of bodily health, tho of as clear memory as usual, thanks to God for the same, do this day make this my last Will and Testament.
I most humbly recommend my Soul to that extensive mercy of the Supreme Being who gave it to me, my worldly estate I dispose in manner and form following:
First. I give to my well beloved Wife all my House Hold Furniture and indoor moveables forever to sell or give to whom she may think proper. And I give one third part of my real estate of Lands to her during her natural life, I mean of all I possess in the Commonwealth of Massachusetts I give her one cow and four sheep.
Item. I give and devise to my son Daniel Burt one fourth part of all my Real Estate in the Commonwealth of Massachusetts which shall be remaining after my debts are paid, and to be divided or set off out of the two third so as to be clear of the incumbrance of my wife's third and to be done as soon as my just debts shall be paid. And all my Real Estate situate at the Genessee in the State of New York.
Item. I give and bequeath to my daughter Betsy Burt one hundred and fifty dollars, and the same amount in Furniture for housekeeping house as I have given to my daughter Thankful Walker and to be paid out of the remaining part of my Real Estate in this Commonwealth afor the one fourth part is set off to my son Daniel .
And all that shall remain of the three quarters of my Real Estate, after my debts and the Legacy given to my daughter Betsey as said, I give and devise to my two Daughters Betsey Burt and Thankful Walker to be equally divided between them.
And I do nominate and appoint my brother Henry Burt of Taunton to be my Executor to this my last will and Testament and he to pay my just debts, funeral charges and Legacies and to receive my credits.
And all the remainder and residue of my Estate whether in Stock or outdoor moveables or in whatever else not expressly given away in this will I order my Executor to sell for the discharge of my debts as far as it will go.

On 2 Dec 1802 Peter Walker, Thomas Lee & Gideon Hicks presented the widow's third at $620.33
The homestead farm with buildings and 90 acres as well as a wood lot of 12 acres were valued at $1885.
The widow received 22 acres and 73 rods on the north side of the homestead and 2 acres 112 rods of the wood lot near Elisha Briggs' dwelling house.

4 April 1803
Pursuant to a warrant to us directed by the Honorable Seth Padelford, Esq. Judge of the Probate of Wills, etc. for the county of Bristol, we the subscribers, having been first sworn, and notified the interested parties, have made division of the Estate of Daniel Burt deceased, therein named, which has not been set off to the widow for her third, according to the last Will and Testament of said deceased.
There being three children and heirs of said deceased viz Daniel Burt, Thankful Walker and Betsey Burt.
Daniel Burt, son of said deceased, transfers by Deed his Right and Interest in said Estate conjointly and separately to Thankful Walker and Betsey Burt for the sum of four hundred and twenty dollars, his rights being one fourth part of the whole of said deceased Real Estate in the Commonwealth of Massachusetts, after said deceased's debts were paid as appraised in said Will....[property description mentions adjoining lands of Gideon Hicks, Thomas Burt, Peter Burt, Thomas Lee, Edmund Burt]

Daniel Burt is characterized as living in his father's homestead on Burt St., which now [1893] forms part of the estate of the late George Walker, Esq. [In the Life & Times of Henry & Ulalia Burt--a section on the Taunton Burts]. The history of Southeastern Mass. characterizes this location as on the Segreganset river. Another author suggests the location is about where the Segreganset Country Club is located [handwritten manuscript, year?].
