He was only 39 years old. After a simple funeral service consisting of a prayer by his neighbor and good friend Deacon David Thomas and some hymns his body was taken for burial in Green's Prairie Cemetery in Postville, Green Co., WI.

After Josiah's wife died in Madison, WI in 1894 it was decided to move Josiah's body to to be buried in Madison beside her. His son Robert "Fighting Bob" LaFollette consulted with his friend, Dr. Cornelius Harper, as to the necessary preparations. Then Robert drove with his brother William to Postville with a gravedigger. When the gravedigger dug down the coffin they found had rotted but they could still tell where the coffin had been. Bob himself jumped into the grave and carefully removed the remains of his father's skeleton. The bones were reburied in the Forest Hill Cemetery in Madison WI on April 23, 1894.
