Ms. Beulah Courtney Hipps of Matthews, NC had personal knowledge and had cared for these graves prior to the destruction. She was grandaughter of James Wade Nates and Caroline (Carolyn) Nates. It was taken to court and she was granted the right to erect a memorial marker with the names of those who were buried there. This is on a corner lot fenced in above the road level. The court granted access to the cemetery plot. The memorial marker is covered by shrubbery, although the landscaping is very nice.
Transcibed in brief from the court hearings on this cemetery claim:
"Historically, John T. Buff had dedicated the said portion of the property as a graveyard, one acre more or less."
After the subdivision was constructed and this went to court, it was identified as lots 5,6, and 7 of Chartwell Subdivision and that this ground was used as a graveyard for more than 100 years. There was erected upon said graveyard, tombstones in one form or another marking existing graves.
"This Court do enjoin Defendants from interfering with Plaintiff's, or others situated, going upon this premises and engaging in any and all reasonalble acts to give proper recognition to pay respect to the graves of their ancestors, Columbia, South Carolina, 1965."
This cemetery is located at 104 Chelveston Drive in Chartwell Subdivision off of Saint Andrews Road near Intersate 26. The Nates cemetery was destroyed by developers when the housing project was installed.
