James Bay was age 8 on the 1850 Hamilton, Lee, Illinois census with Joseph Bay, age 48 born in Ohio, and Elizabeth, age 45, and seven siblings. This family was at Emporia, Breckenridge County, Kansas Territory in 1860. Breckenridge County was abolished in 1861. Emporia is now in Lyon County, Kansas.

James Bay, a resident of Emporia, Kansas, enlisted in November of 1861 as a Private in Co. B of the 9th Kansas Cavalry. He mustered out in July of 1865 at DeVall's Bluff, Arkansas.

James was listed with his parents and siblings on the 1865 Kansas State census at Iola, Allen, Kansas. This census records his military service. By 1870, he was listed with Josephine in Avon Township of Coffey County, Kansas. "Edney" was 2 months old.

In 1875 they were living in Agency Township of Osage County, Kansas with Edna, age 5, and Lola, age 1. The 1880 census adds Orville, age 3, and also Joseph Bay, age 77, born in Ohio, who was listed as James' father, a widower.

James and Josephine lived at Williamsburg in Franklin County, Kansas in 1900 and 1910. Their marriage year is listed as 1867 on the 1900 report, when they were with their daughter, Edna Horne, wife of Charles W. Horne. The 1910 census states that they had been married for 43 years. Josephine was the mother of four, with two living. Two granddaughters were with them in 1910, both age 14, Velma F. Burriss and Dessa O. Bay.

James was a brother of John Bay, # 91744258.
