Joseph was born in New Jersey to Daniel and Mary (Clayton) Stockton, the exact date is not known and 1762 is only an estimate. His father's will named Joseph as the eldest son.

Joseph married Ann Pattison in Guilford county NC in 1787 and had at least seven children in North Carolina: Daniel, Sarah, William, Joseph, Mary Ann, John Clayton, and Elizabeth. Joseph moved around a bit in North Carolina and was listed in Stokes county in 1790, in Surry county in 1800 and 1810 and Iredell county in 1820. In 1830 he was in Rhea county, Tennessee.

In the matters of the Estate of Joseph C Stockton, deceased
In the matters of the petition in this case, it was ordered by the Court that John Stockton, George Bennick, Elizabeth Bennick, Daniel Stockton, Mary Bass, Sarah Pettit, Nancy Stockton, and Joseph P Stockton as heirs, and all persons interested in the following lands to wit, the North East Quarters of Section 15, in Township 8 of Range 10 East as tenants or heirs at law of said Joseph C Stockton, be and personally appear at a Probate Court to be holden [sic] in the Court House in the Town of Fulton on the first Monday of Agust [sic] next; and show cause why said lands shall not be sold for the purpose of distribution & c.
And that publication of this Notice be made in the Fulton Herald, a newspaper published in the Town of Fulton Miss and the Southern Tribute, a newspaper published in the Town of Aberdeen....
