Enrolled 29 April 1861 at Winchester, Franklin County, Tennessee and is recorded as the regiment's first desertion. Mitchell, who had put his name down for enrolment on April 29th, failed to turn up for muster and became the first statistical record of the regiment. He placed his name on the roll and then disappeared without further ado but may have joined up with the 16th Tennessee Infantry.
