Will of James Rogers Whitley County Will Book 1, p. 120-122 (book covers years 1818-1854)
In the name of God Amen.. I James Rogers Sen. of the county of Whitley and State of Kentucky being old and infirm but of sound and disposing mind and memory and wishing to dispose of my worldly estate do make and ordain this my (sic) last will and testament in the words and figures as followeth (to wit ) 1st it is my will and desire that all my Just Debts be paid off and discharged with any money I may leave and if that is not sufficient to discharge the same then to be paid out of the proceeds of my personal property which is not hereafter otherwise disposed of Second, I give and bequeath unto my son James Rogers all that portion of the tract of Land on which I now live which lies on the South side of Laurel River and adjoining the Land on which he now lives 3rd I give and bequeath unto my daughter Jane Morse (MOORE) and her children for their use and benefit alone the land on which Gilbert Morse (MOORE) now lives supposed to be thirty acres by certain boundaries known and agreed upon and in as much as I do not wish Gilbert Morse the husband of my said Daughter Jane to have it in his power to sell or dispose of the said thirty acres of Land or to have the same sold for his debts it is therefore clearly the intention of the testator that the said land shall inure to the sole benefit of the said Jane and her children free from any right or power in her husband to alienate the same 4th I give and bequeath to my granddaughter Judith and her husband Richardson (RICHARD) Alsop the fifty acre tract of Land I bought of John Rogers and upon which the now live and I confirm the title to all the property already given them 5th I give and bequeath unto my Daughters Nancy & Margaret all the personal property I may have at my death after the payment of my Debts as before directed I also give and bequeath to my said Daughters Nancy & Margaret the tract of Land on which I now live and about twenty acres adjoining the same it being a part of a fifty acre tract thirty acres of which I have given to my Daughter Jane and her children and if I should die before my beloved wife Judith I desire my daughters Nancy and Margaret to take good care of her during her life and should they fail so to do to her satisfaction I desire and request her to claim her right of Dower in the land and personal property given to them and to hold (sic) the same during her life and at her Death to go to my said daughters Nancy & Margaret. 6 My will and desire is that immediately after my death or as soon as convenient and the Law will permit to sell the fifty acre tract of Land I own on Laurel River at the mouth of Whipperwill creek & the money arising from the sale of the same I desire to be disposed of as follows I give one
p. 122 (continued) dollar to each of my sons William and John one Dollar to my son Prior One dollar to my Daughters Sally Stephinson (STINSON) one Dollar to my Daughter Rebecca Griffith and one dollar to my Daughter Mary Sexsen (SEXTON) and the residue if any to go to the payment of my Debts and lastly I hereby declare this my last will and testament hereby revoking former will or wills In witness whereof I hereunto set my hand and seal this 19th day of June 1848 In presence of Joseph Gilliss Henry D. Harman
Codicel 1st I give and bequeath unto my Grand children Judith Morse (MOORE) and James B Morse two Cows which they have now in possession for their own proper use and benefit and the right of said Cows is vested in the said Judith and James B. exclusive of an righ or contract of their Father or any person whatever in witness whereof I have hereunto set my hand and seal in presence of Joseph Gilliss Henry D. Harman
State of Kentucky Whitley County Court Sct. December Term 1848
I Addison Williams Clerk of the county Court for the county aforesaid do hereby Certify that the foregoing will and testament together with the Codicil thereof of James Rogers was this day produced in Open Court and proven to be the act and Deed of the said James Rogers by the oaths of Joseph Gilliss and Henry D. Harman Subscribing witness thereunto and the same was ordered to be recorded by the court.
