Sgt Felipe Gutierres served with Company C of the 1st New Mexico Infantry Regiment (Old). The Regiment was organized at Fort Union and Santa Fe from July 1 to August 13, 1861 and held duty at Fort Union until February 1862. On 21 February 1862, the regiment participated in the Battle of Valverde against Confederate Texas forces. During April 13-22, the regiment pursued Confederate forces while holding duty in Central, Northern and Santa Fe Districts. However, Felipe was recorded as in "confinement" during Mar & Apr 1862.

On May 31, 1862; the regiment was consolidated with 2nd, 4th, and 5th Infantry Regiments to form 1st New Mexico Cavalry. "Private" Felipe Gutierres was described as age 37 (B: ~1825), 5 feet 6 inches, dark complexion, dark eyes, dark hair, a laborer, and originally enlisting on 3 July 1861 in Santa Fe. The Cavalry Regiment engaged in operations against Indians in New Mexico and Arizona that attempted to exploit the military attention on the Civil War. Felipe was mostly in the Quartermaster Detachment herding cattle. Felipe's term of service expired on July 31, 1864 and he was discharged at Fort Stanton. On 2 Aug 1890, Felipe Gutierres filed for his military pension as an invalid. His units were recorded as "C 1 N.Mex.Inf." and "A 1 N.Mex.Cav."
