According to the cemetery main page . . . "Established in 1867, the growth of the city of Hays caused all graves to be moved to Mount Allen Cemetery in 1874. Today, all that exists on the original site is a commemorative statue called 'The Homesteader'."

The notorious "Pony" Donovan was known as the King of the Horse Thieves. Showing remarkably bad timing, he was arrested while walking down the streets of Hays and thrown in jail.
Another badman, Bill McClellan was being held for the murder of John F. "Jack" Wright over the love of a young maiden, Nellie Baldwin.
Both Donovan and McClellan were held in the same room in the basement of the courthouse, McClellan chained to a supporting post. One night friends of Wright, determined to avenge his death snuck up to the cellar window, stuck their rifles in and began pouring gunfire into that basement, killing Donovan and not hitting McClellan.
