I have been told by a family member that Henry Horne was buried in the yard of the home in Lothair he shared with Ruth. He was moved to the Lothair Cemetery beside his 1st wife, Charity Williams Horne. Only a shovel of dirt could be moved.
I visited Charity Horne's grave in 2012 and there is no sign of his grave beside her. There is an empty space that could be an unmarked grave, but no marker is there.

((*Von Arnette (1884-1852) is listed as a child of Henry Horne. To our knowledge this is incorrect information.))

On Saturday evening September 22, 1883, David Butler was shot and killed by Henry Horne, at Frank Edward's store in White Horse Township. Two whiskey wagons were in camp and a considerable crowd had gathered. The whiskey, no doubt, flowed freely.
A 10 year feud had existed between the Horne and the Butler families.
James Horne and David Butler met on the road and began quarreling. James seized a large slab of wood and was walking toward Butler. Butler drew his pistol and ordered him not to advance toward him further. Horne threw the slab at Butler, Butler then fired at Horne. The shot hit Horne in the thigh, inflicting a painful but not serious wound. As soon as this took place, Henry and Marshall Horne, brothers of James, came out of the store and walked in the direction of Butler. Horne immediately shot Butler through the collar bone killing him almost instantly, in defense of himself and his brothers.
Henry Horne took his wife Charity and 5 children, fled the state and changed their last name from Horne to Johnson.
In 1894, Henry Horne returned to North Carolina and surrendered himself. He was tried and convicted of murder in the first degree, by Judge Mearse. He appealed to the Supreme Court and was granted a new trial. Horne never denied the killing but Butler had just shot his brother. The case was dismissed and he was freed due to self-defense.
Henry Horne and his family all changed their last name back to Horne, but Charlie Johnson did not. Charlie (Horne) Johnson, the oldest child, had married and started a family under the assumed Johnson name.
Charlie Johnson was my grandfather and I think the story needs to be told.
