Mary Lovering Holman says: Ebenezer Knapp, father of Philo Sherman's wife, married secondly Christiana Bailie, and, after his death, evidence for some reason was desired to prove his first marriage. His will and the documentary evidence of his first marriage are given here to prove the parentage of Beulah Knapp, her descendants seeming in doubt as to her parentage. Last Will of Ebenezer Knapp 16 Apr 1828
Registered 30 Nov 1854

A Memorial to be registered pursuant to the Statute in such case made and provided. Of a will in the words following, this is to say:

"In the name of God, Amen, I Ebenezer Knapp of Bastard in the Province of Upper Canada being weak of body but of sound mind and perfect memory do make and ordain this my last will and testament in manner and form following (that is to say) firstly, I give demise and bequeath to my beloved wife Christiana Knapp otherwise Christiana Bailie during her natural life the East half of that farm or tract of land on which I know reside being composed of the west half of lot number six (with the exception of twenty five acres) in the ninth concession of Bastard said demised land containing seventy five acres more or less ~ Secondly the above demised and described land or premises (to wit) part of the west half of lot number six in the ninth concession aforesaid. I give demise and bequeath to Charlotte Chaddoc wife to Elisha Chaddoc of Bastard aforesaid or the reversion thereof at the death or demise of the above named Christiana Knapp otherwise Christiana Bailie is hereby bequeathed to the said Charlotte Chaddoc her heirs and assigns forever. ~ Thirdly all the residue of my real or freehold property I give demise and bequeath to my daughter Beulah Sherman her heirs and assigns forever (to wit the rear half of the lot number two in the ninth concession of Bastard and the East half of lot number seven in the said ninth concession of Bastard (with the exception of twenty five acres in front thereof) with all mills, mills seats, water privileges, privileges or appurtenances to the said premises or estate in any wise belonging. ~ Fourthly I give and demise and bequeath to my daughter Beulah Sherman a certain bay mare, now owned by me in lieu of said mare, twenty five pounds value in stock off my farm. ~ Fifthly all the residue of my personal Estate, property, stock, crops and household furniture, farming utensils and debt and amounts in my favour I give and demise and bequeath to my wife Christiana Knapp otherwise Bailie for her benefit and use and at her disposal. I hereby constitute nominate and appoint Ithamer Knapp, Israel Knapp and Philo Sherman of this my last will and testament executors hereby revoking and annuling all other will or wills by me heretofore made In testimony whereof. I hereby set my hand and seal this sixteenth day of April one thousand eight hundred and twenty eight.

Mary Lovering Holman says:

In 1935, some old papers were discovered in the farmhouse once occupied by Philo Sherman and sent to the compiler of this genealogy. They consisted of a will, a depostion in fragments, a receipt, and an indenture. The will was one made by Philo (or as he spelled the name Philow) Sherman. The deposition related to Ebenezer Knapp, the receipt was from his widow, and the indenture one between Israel Knapp and Philo Sherman. Later another peice of the deposition was discovered by another search. These papers are all given here: In nearly all the wills of these Canadians it will be seen that no attempt is made to name all the heirs. Apparently the sons were given land by deeds or in some way their claim against their parent's estates were satisfied before the wills were drawn and then the testator gave the residue to whom he pleased.

The depostion after the fragments found were aligned reads as follows:

noch Palmer of the town of
ty, being duly Sworn, before
the Justices of the Peace of Said
county aforesaid, makes Oath
and says--that he was well acquainted with Ebenezer
Knapp, formerly of the town of Chatham aforesaid
and latterly of Upper Canada, a colony of Great
Britain, and knew Said Knapp, in Canada aforesaid
lived aneighbour to him, both in Chatham and in
Canada: and he also further Says--that he was well
acquainted with his Wife when said Ebenezer Knapp
married hir by the name of Lydia Marks that
the said Ebenezer Knapp was married to the Said
Lydia Marks about forty one or two Years ago and
this deponent further says--that he was present at
their marriage and was married by Samuel Wheeler
Esquire then an acting Justice of the peace of the town
of Canaan in Said County of Columbia, and
further this deponent Saith not

This receipt shows that Philo Sherman and his wife Beulah (Knapp) Sherman settled the estate of Ebenezer Knapp.

"I hereby Certify that I have received from Philo Sherman and Beulah Sherman Legal Heirs of the Estate of Ebenezer Knap Deceased the sum of one hundred Pounds St Currency it being in full of all Demands Accounts or any Claim whatsoever against the said Estate In testimony whereof I have hereunto set my hand this thirtieth day of June one thousand eight hundred and twenty-eight
